Confirmation of Order - The quotations given shall not be binding unless confirmed in writing by Myburgh Designs. Myburgh Designs shall only be committed upon acceptance of the order duly drawn up by us.
Delivery - Our swings are quoted ex-warehouse. Delivery will be arranged as a separate contract and the purchaser shall reimburse Myburgh Designs for all direct and indirect costs relating to delivery. It is the responsibility of the client to ensure to check the goods on arrival and notify Myburgh Designs of any defects immediately. If for reasons resting with the client delivery is delayed by more than two weeks storage will be charged to the client.
Delivery period - As customary in the trade the delivery period is only indicative and any delay shall not give rise to compensation.
Change Order - If while the order is being processed the client requests to change the original order will require Myburgh Designs’s agreement in writing and may incur adjustment in prices and payment terms.
Deferred Payment - In the event of non payment Myburgh Designs has the right to terminate the contract. Installments already paid shall be kept by Myburgh Designs as contractual penalty.
Guarantees - We guarantee that our swings are manufactured in accordance with professional standards. The guarantee does not cover damages resulting from causes attributable to the buyer (neglect, irrational or improper use, abnormal wear and tear, corrosion) or damages caused by third parties or by acts of God. Unless previously agreed no return of goods shall be accepted.
Price - Except for the reservations expressly stated or for an unforeseeable increase in operating expenses (raw materials, energy), the prices of our products are as stated on the confirmation of the order.
Terms of Payment - 40% deposit with order and the balance is due 7 days prior to delivery. In the event the Myburgh Designs were unable to deliver the items in the order within the period requested because the client has not met his obligations Myburgh Designs have the right to request payment by the client of 80% of the price of the order already completed.
Reserve of Ownership - Transfer of ownership shall occur upon payment of the prices by the buyer. Until payment is received the swings remain the property of Myburgh Designs.
Transfer of Risk - As the swings sold are deemed to remain property of Myburgh Designs until full payment is received, any person receiving the goods before full payment of the price shall be its custodian and shall be responsible for any damage which may occur.
The Trees - Myburgh Designs take no responsibility over the strength of the tree on which they hang the swings any doubts then the client must employ a professional tree surgeon to check the tree .
